recrimination

recrimination
/rakrimaneyshan/
A charge made by an accused person against the accuser; in particular a counter-charge of adultery or cruelty made by one charged with the same offense in a suit for divorce, against the person who has charged him or her.
Under doctrine of "recrimination", if conduct of both husband and wife has been such as to furnish grounds for divorce neither is entitled to relief. Mason v. Mason, 276 Ala. 265, 160 So.2d 881, 882.
A showing by the defendant of any cause of divorce against the plaintiff, in bar of the plaintiffs cause of divorce. And to bar divorce, complainant's misconduct need not be of equal degree with that of defendant, but must be of same general character. The defense of recrimination has been abolished in many states with the enactment of "no-fault" divorce statutes
